RISK OF LOSS

All items purchased from Haloperformance are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

PRODUCT DESCRIPTIONS

Haloperformance attempts to be as accurate as possible. However, Haloperformance does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Haloperformance itself is not as described, your sole remedy is to return it in unused condition.

PRICING

Except where noted otherwise, the List Price displayed for products on our website represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere.

Haloperformance cannot confirm the price of an item until you order; however, we do NOT charge your credit card until after your order has entered the shipping process or you have agreed to wait for items placed on back order. Despite our best efforts, a small number of the items may be mispriced. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

Advice given by Haloperformance in writing or telephone is based entirely upon information given by the purchaser. As such, all advice given is indicative only and should be checked by the purchaser prior to order.

Goods are supplied are only intended for use as directed by the manufacturer of the product. Haloperformance accepts no liability for injury, costs, loss or damage incurred for incorrect use, modification or amendment to any product supplied by Haloperformance.

Haloperformance shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods. Any indicated delivery dates are approximate.

All goods are subject to availability. If we cannot supply the goods for any reason your credit/debit card will not be charged. Haloperformance will not be responsible for compensating you for any other losses which you may suffer if we do not supply the goods.

Goods manufactured or special ordered for the purchaser are non returnable under any circumstances except for defective goods. Once written confirmation has been obtained from the purchaser for manufactured or special ordered goods it cannot be cancelled or refunded.

Defective goods will be subject to full inspection by the UK importer/manufacturer. The UK importer/manufacturer will replace the goods if found to be defective. Haloperformance has no liability or obligation to supply replacement goods if rejected for any reason by the UK importer/manufacturer.

Haloperformance will not be held liable for any fitting charges incurred by the purchaser. It is the purchaser's responsibility to ensure he has the correct parts prior to fitting. In the event of a defective item we shall act on the customer's behalf to obtain compensation for fitting charges from the manufacturer/UK importer. If the manufacturer/importer refuses compensation then Haloperformance shall not be held liable.

No liability is accepted by Haloperformance where purchasers attempt to modify or install components where it is known or ought reasonably to be known to the purchaser that the part is incorrectly supplied or otherwise not in accordance with the order.

APPLICABLE LAW

This Contract will be governed by English law and you consent to the non-exclusive jurisdiction of the English courts in all matters regarding it

FORCE MAJEURE

We will not be liable for any failure in the performance of any of our obligations under the Contract caused by factors outside our control.
